Terms of Service
Effective Date: March 14th, 2026
1. Definitions
For the purposes of these Terms of Service, the following terms have the meanings set out below:
- "EventIQ," "we," "our," "us" refers to Event IQ Labs Private Limited, the operator of the EventIQ platform.
- "Customer" means an event manager, event owner, or their authorised team member who creates an account on the EventIQ platform and uses it to manage events, upload guest lists, and initiate communications.
- "Guest" or "Recipient" means an individual who receives WhatsApp messages, invitations, reminders, or other communications sent through the EventIQ platform on behalf of a Customer, or who interacts with such communications (for example, by submitting RSVP responses).
- "User" or "you" refers to any individual or entity accessing or using the EventIQ platform, whether as a Customer or as a Guest/Recipient.
- "Platform" means the EventIQ software, website (event-iq.in), dashboard, APIs, and all related tools and services.
- "Services" means the event communication, RSVP workflow, contact management, communication orchestration, tracking, analytics, and related operational services provided by EventIQ.
- "Customer Data" means all data uploaded, entered, or generated by or on behalf of a Customer through the Platform, including guest lists, event details, message content, and RSVP responses.
- "WABA" means the WhatsApp Business API, provided through Meta Platforms, Inc.
- "Privacy Policy" means EventIQ's Privacy Policy, available at event-iq.in/privacy-policy, as updated from time to time.
- "DPDP Act" means the Digital Personal Data Protection Act, 2023, and any rules, regulations, or notifications issued thereunder.
2. Acceptance of Terms
By creating an account on the EventIQ platform, accessing or using any of our Services, or interacting with communications sent through our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.
If you are accepting these Terms on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "Customer" refer to that entity.
If you do not agree to these Terms, do not create an account or use the Services.
You must be at least eighteen (18) years of age to create an account or use the Services as a Customer. By creating an account, you represent that you meet this age requirement.

For the purposes of applicable data protection law, EventIQ acts as a Data Fiduciary with respect to personal data we collect directly from Customers, and as a Data Processor when we process Guest and Recipient data on behalf of Customers. Please refer to our Privacy Policy for full details of our data protection roles and responsibilities.
4. Scope of Services
EventIQ provides an event communication and RSVP operations platform that enables Customers to:
- Create and manage events on the platform dashboard.
- Upload and manage guest and recipient contact lists.
- Compose and send WhatsApp messages, invitations, reminders, and other event-related communications using the official WhatsApp Business API (WABA).
- Collect RSVP responses and manage two-way WhatsApp conversations with Guests and Recipients.
- Facilitate opt-in consent collection through IVR (Interactive Voice Response) workflows, where instructed by the Customer.
- Access delivery reports, RSVP summaries, and communication performance analytics for their own events.
- Manage related event operational workflows, including contact management, communication orchestration, and tracking.
Service availability, messaging throughput, and message delivery depend in part on third-party platforms, including Meta Platforms, Inc. (WhatsApp), and are subject to their terms, policies, and platform enforcement decisions. EventIQ does not guarantee uninterrupted availability or delivery of messages sent through third-party platforms.
For Guests and Recipients, EventIQ facilitates the receipt of event-related WhatsApp communications and the ability to respond to those communications (including RSVP responses and two-way chat) on behalf of the Customer who initiated the communication.
5. Account and Customer Responsibilities
As a Customer, you agree to the following obligations:
a. Account Security
You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at company@event-iq.in if you become aware of any unauthorised use of your account.
b. Lawful Use
You are responsible for ensuring that your use of the Services, including all data you upload, message campaigns you initiate, and actions taken by your authorised team members, complies with all applicable laws, regulations, and platform policies, including the DPDP Act, the Information Technology Act, 2000, and Meta's WhatsApp Business Policy and Commerce Policy.
c. Data Fiduciary Obligations
When you upload Guest and Recipient data to the Platform, you act as the Data Fiduciary for that data under the DPDP Act. You are responsible for establishing and maintaining a lawful basis for the collection and processing of such data, providing required notices to data principals, and responding to data principal rights requests to the extent required by law. EventIQ processes such data as your Data Processor, under your instructions and subject to these Terms and our Privacy Policy.
d. Opt-In Responsibility
You are responsible for ensuring that valid opt-in consent has been obtained from each Recipient before initiating WhatsApp messaging campaigns through the Platform, in accordance with Meta's WhatsApp Business Policy and applicable law. You must maintain records of opt-in consent and make them available to EventIQ upon request. Where EventIQ facilitates opt-in collection through IVR workflows on your instructions, you remain responsible for the adequacy and lawfulness of the consent obtained.
e. Opt-Out Compliance
EventIQ processes opt-out requests received from Recipients through automated keyword detection on WhatsApp and manual support channels, as described in our Privacy Policy. You must honour all opt-out requests and must not re-message Recipients who have opted out unless fresh, valid opt-in consent has been obtained.
f. Children's Data
If any Guests or Recipients on your guest lists are under the age of eighteen (18) years, you are responsible for ensuring that verifiable parental or guardian consent has been obtained in accordance with the DPDP Act before submitting such data to the Platform.
g. Accuracy of Data
You are responsible for the accuracy, quality, and legality of Customer Data you upload to the Platform and the means by which you acquired such data.
6. WhatsApp Business API and Meta Platform Terms
a. Official API Usage
EventIQ uses the official WhatsApp Business API (WABA), provided through Meta Platforms, Inc., for all WhatsApp communication workflows. We do not use unofficial, reverse-engineered, or unauthorised WhatsApp interfaces.
b. Meta Policy Compliance
All WhatsApp communications sent through the Platform are subject to Meta's WhatsApp Business Policy, Commerce Policy, and related terms. Customers are independently responsible for familiarising themselves with and complying with these policies. Violation of Meta's policies may result in message delivery restrictions, template rejections, account limitations, or other enforcement actions by Meta, for which EventIQ shall not be liable.
c. Message Templates and Approvals
WhatsApp message templates used through the Platform are subject to Meta's template review and approval process. EventIQ does not guarantee approval of any particular message template. Rejection or revocation of templates by Meta may affect the Customer's ability to send certain types of messages.
d. Opt-In and Consent Collection
Under Meta's WhatsApp Business Policy, Recipients must provide opt-in consent before receiving WhatsApp messages. EventIQ may facilitate opt-in collection through IVR (Interactive Voice Response) workflows where instructed by the Customer. The Customer remains solely responsible for the lawful basis, consent quality, recipient targeting, and record-keeping associated with opt-in consent. EventIQ does not independently verify the validity of opt-in consent provided by Customers.
e. Opt-Out Processing
EventIQ supports the following opt-out mechanisms for Recipients:
- On WhatsApp: Recipients may reply with keywords such as "STOP," "UNSUBSCRIBE," or "OPT OUT." The Platform automatically detects these keywords and processes the opt-out.
- Off WhatsApp: Recipients may email company@event-iq.in with the subject line "Opt-Out Request," including the phone number to be removed.
- Via Customer Support: Recipients may request opt-out through any communication channel with our support team.
Opt-out requests are processed promptly, and no further messages will be sent to the opted-out number for that event or Customer unless fresh opt-in consent is obtained. EventIQ maintains records of all opt-out requests.
f. Sensitive Data Prohibition
Customers must not use EventIQ's WhatsApp messaging Services to transmit sensitive personal data, including but not limited to payment card numbers, bank account details, government-issued identification numbers, health information, passwords, or financial account credentials. EventIQ does not process payment transactions and does not store payment card information.
g. Data Isolation
Guest and Recipient data uploaded by one Customer is strictly isolated from other Customers' data. No Customer can access, view, or obtain data belonging to another Customer. EventIQ does not share, aggregate, or cross-reference Recipient data across Customers.
h. Service Dependency
Message delivery, read receipts, and related functionality depend on Meta's WhatsApp infrastructure. EventIQ is not liable for delivery failures, delays, or disruptions caused by Meta's platform, policies, or enforcement actions.

7. Identity (ID) Data Handling
- ID data (such as government-issued identification documents or numbers) is collected only when a Customer chooses to collect it for a specific, required purpose (such as venue access verification), and only through secure Platform workflows.
- ID data is processed solely for the stated purpose and is not used for any other reason.
- ID data is permanently deleted promptly after the relevant purpose is completed.
- Retention of ID data beyond purpose completion occurs only where required by applicable law.
- ID data is collected and processed under the Customer's instructions, with EventIQ acting as Data Processor.

8. Prohibited Uses
You must not use the EventIQ Platform or Services to:
- Send unlawful, deceptive, abusive, harassing, threatening, defamatory, or otherwise objectionable communications.
- Send spam, unsolicited commercial messages, or bulk messages to individuals who have not provided valid opt-in consent.
- Process personal data without required permissions, notices, or lawful basis under applicable law.
- Transmit sensitive personal data through WhatsApp messages, as described in Section 6(f).
- Upload or process personal data of children under the age of eighteen (18) without verifiable parental or guardian consent as required by the DPDP Act.
- Circumvent, disable, or interfere with opt-out mechanisms or re-message Recipients who have opted out without obtaining fresh opt-in consent.
- Attempt unauthorised access to, reverse engineering of, or disruption of Platform systems, other users' accounts, or Customer Data belonging to other Customers.
- Use the Platform for any purpose other than event communication and RSVP operations as described in these Terms.
- Violate Meta's WhatsApp Business Policy, Commerce Policy, or any applicable platform terms.
- Use the Platform from or in connection with any jurisdiction that has been restricted by the Central Government under the DPDP Act.
- Introduce viruses, malware, or other harmful code into the Platform.
- Resell, sublicense, or make the Platform available to third parties, except as expressly permitted.
- Use the Platform in any manner that could damage, disable, overburden, or impair EventIQ's infrastructure or interfere with any other party's use of the Platform.
EventIQ reserves the right to investigate suspected violations and to suspend or terminate access in accordance with Section 18.
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, storage, sharing, and protection of personal data are governed by our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.
Key provisions include:
- Data Roles: EventIQ acts as Data Fiduciary for Customer account data and as Data Processor for Guest and Recipient data processed on behalf of Customers.
- Data Use Limitations: We use personal data solely for service delivery, same-event analytics, platform security, and legal compliance. We do not sell data, engage in cross-event aggregation, or use data for AI training or advertising.
- Data Residency: Personal data is stored and processed primarily on servers located in India.
- Data Retention: Specific retention periods apply to different data categories, as detailed in Section 9 of our Privacy Policy.
- Your Rights: Data principals have rights of access, correction, erasure, consent withdrawal, nomination, and grievance redressal under the DPDP Act.
Customers who upload Guest and Recipient data to the Platform acknowledge their obligations as Data Fiduciaries under the DPDP Act, including the duty to provide notice to data principals, obtain consent where required, and respond to rights requests.
10. Customer Data Ownership and Licence
a. Ownership
As between EventIQ and the Customer, all Customer Data remains the property of the Customer. EventIQ does not claim any ownership interest in Customer Data.
b. Licence to EventIQ
By uploading or submitting Customer Data to the Platform, the Customer grants EventIQ a limited, non-exclusive, royalty-free licence to process, store, transmit, and display Customer Data solely as necessary to provide the Services, comply with these Terms, and fulfil our legal obligations. This licence terminates upon deletion of the relevant Customer Data or termination of the Customer's account, subject to any legally required retention.
c. Feedback
If you provide suggestions, feature requests, or other feedback regarding the Services, EventIQ may use such feedback without restriction or obligation to you.
11. Intellectual Property
EventIQ and its licensors retain all rights, title, and interest in and to the Platform, including all software, source code, documentation, designs, trademarks, service marks, logos, and other intellectual property associated with EventIQ. These Terms do not grant you any right, title, or interest in EventIQ's intellectual property except for the limited right to access and use the Platform in accordance with these Terms.
You must not:
- Copy, modify, adapt, or create derivative works based on the Platform or any part thereof.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform.
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Platform.
- Use EventIQ's trademarks, logos, or brand elements without our prior written consent.
12. Third-Party Services
EventIQ relies on third-party infrastructure and service providers to deliver the Services. These currently include:
- Meta Platforms, Inc. (WhatsApp Business API): For WhatsApp message delivery and related functionality.
- Cloud hosting providers: For data storage and processing infrastructure, with servers located in India.
The availability, performance, and functionality of these third-party services are outside EventIQ's control. Changes to, interruptions of, or restrictions imposed by third-party providers may affect Platform functionality. EventIQ is not responsible for the acts, omissions, terms, or data practices of third-party service providers.
Customers are independently bound by the terms and policies of any third-party services they interact with in connection with their use of the Platform. For details on how we share data with third parties, please refer to Section 8 of our Privacy Policy.
13. Commercial Terms
EventIQ currently does not charge subscription fees or other payments for use of the Platform. No paid subscription, billing, or refund terms apply at this time.
If paid plans are introduced in the future, updated commercial terms (including pricing, billing cycles, payment methods, refund policies, and related provisions) will be published and communicated to Customers before any charges apply. Customers will not be charged without prior notice and, where required, explicit consent.
14. Confidentiality
Each party acknowledges that it may receive or have access to confidential information of the other party in connection with these Terms and the Services.
"Confidential Information" means all non-public information disclosed by one party to the other that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure, including Customer Data, business plans, technical specifications, and security measures.
Each party agrees to: (a) hold the other party's Confidential Information in strict confidence; (b) not disclose it to any third party except as necessary to perform its obligations under these Terms and subject to equivalent confidentiality obligations; and (c) use it only for the purposes contemplated by these Terms.
These obligations do not apply to information that: (i) is or becomes publicly available through no fault of the receiving party; (ii) was known to the receiving party before disclosure; (iii) is independently developed by the receiving party; or (iv) is required to be disclosed by law, regulation, or court order, provided that the receiving party gives the disclosing party reasonable prior notice where permitted.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, EventIQ provides the Platform and Services on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
EventIQ specifically disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Without limiting the foregoing, EventIQ does not warrant that:
- The Platform or Services will be uninterrupted, timely, secure, or error-free.
- WhatsApp messages sent through the Platform will be delivered, read, or acted upon by Recipients.
- The Platform will meet your specific requirements or expectations.
- Any defects in the Platform will be corrected.
Nothing in these Terms excludes or limits any warranty, condition, or liability that cannot be lawfully excluded or limited under Indian law, including the Consumer Protection Act, 2019.
16. Limitation of Liability
To the fullest extent permitted by applicable law:
- a. EventIQ shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, whether arising out of contract, tort (including negligence), strict liability, or any other theory of liability, even if EventIQ has been advised of the possibility of such damages.
- b. EventIQ's total aggregate liability arising out of or in connection with these Terms or the Services shall not exceed the greater of: (i) the total fees paid by you to EventIQ in the twelve (12) months immediately preceding the event giving rise to the claim; or (ii) five thousand Indian Rupees (INR 5,000).
- c. The limitations set out in this section apply regardless of the form of action and regardless of whether any remedy provided fails of its essential purpose.
- d. Nothing in this section limits EventIQ's liability for: (i) fraud or wilful misconduct; (ii) death or personal injury caused by negligence; or (iii) any liability that cannot be limited or excluded under applicable Indian law.
17. Indemnity
a. Customer Indemnification
You agree to indemnify, defend, and hold harmless EventIQ, its officers, directors, employees, agents, and affiliates from and against all claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your breach of these Terms or any applicable law.
- Your violation of Meta's WhatsApp Business Policy or Commerce Policy.
- Your failure to obtain valid opt-in consent from Recipients or to honour opt-out requests.
- Any claim by a third party (including a Guest, Recipient, or regulatory authority) arising from Customer Data you uploaded or communications you initiated through the Platform.
- Your failure to comply with your obligations as Data Fiduciary under the DPDP Act.
- Your violation of any third party's intellectual property rights through your use of the Platform.
b. Procedure
EventIQ will: (i) promptly notify you of any claim subject to indemnification; (ii) provide reasonable cooperation in the defence of such claim at your expense; and (iii) grant you sole control of the defence and settlement of such claim, provided that no settlement may impose any obligation on EventIQ without our prior written consent.
18. Suspension and Termination
a. Suspension by EventIQ
EventIQ may suspend your access to the Platform, in whole or in part, immediately upon notice if: (i) you breach or are reasonably suspected of breaching these Terms; (ii) your use of the Platform poses a security risk or may cause harm to other users; (iii) suspension is required to comply with applicable law, a court order, or a regulatory directive; or (iv) Meta or any critical third-party provider restricts or suspends the underlying service.
b. Termination by EventIQ
EventIQ may terminate your account and these Terms: (i) immediately upon notice for material breach of these Terms that is not cured within fifteen (15) days of written notice (where the breach is capable of cure); (ii) immediately for violations of Section 8 (Prohibited Uses); or (iii) upon thirty (30) days' notice for any reason, including discontinuation of the Services.
c. Termination by Customer
You may terminate your account at any time by contacting company@event-iq.in or using the account closure functionality on the Platform, if available.
d. Effect of Termination
Upon termination of your account:
- Your right to access and use the Platform ceases immediately.
- Any pending message campaigns may be cancelled without delivery.
- EventIQ will retain Customer Data in accordance with the retention periods set out in Section 9 of our Privacy Policy. Customer account data will be deleted or anonymised within ninety (90) days of account closure, except where retention is required by applicable law.
- You may request export of your Customer Data prior to account closure by contacting company@event-iq.in. EventIQ will make commercially reasonable efforts to facilitate data export in a commonly used electronic format.
e. Survival
The following sections survive termination of these Terms: Sections 1 (Definitions), 7 (Identity Data Handling), 8 (Prohibited Uses — to the extent relevant), 9 (Privacy and Data Protection), 10 (Customer Data Ownership), 11 (Intellectual Property), 14 (Confidentiality), 15 (Disclaimer of Warranties), 16 (Limitation of Liability), 17 (Indemnity), 19 (Governing Law and Dispute Resolution), and 22 (General Provisions).
19. Governing Law and Dispute Resolution
a. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
b. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services (a "Dispute"), the parties shall first attempt to resolve the Dispute through good-faith negotiation for a period of thirty (30) days following written notice of the Dispute.
c. Arbitration
If a Dispute is not resolved through negotiation, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Bangalore, Karnataka, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.
d. Jurisdiction
Notwithstanding the foregoing, either party may seek interim or injunctive relief from the courts of competent jurisdiction in Bangalore, Karnataka, India. Subject to the arbitration clause above, the courts located in Bangalore, Karnataka, India shall have exclusive jurisdiction over any matter not subject to arbitration.
e. Mandatory Consumer Protection Laws
Nothing in this section restricts the right of any individual to seek remedies available under mandatory consumer protection laws applicable in their jurisdiction.
20. Data Security
EventIQ implements reasonable technical and organisational security measures to protect Customer Data and personal data processed through the Platform, as described in Section 10 of our Privacy Policy. These measures include encryption in transit and at rest, role-based access controls, audit logging, and incident response procedures.
Customers are responsible for:
- Maintaining the confidentiality and security of their account credentials.
- Ensuring that access to their account is limited to authorised team members.
- Promptly reporting any suspected security incidents or unauthorised access to company@event-iq.in.
- Implementing appropriate security measures on their own systems when handling data exported from the Platform.
Neither party shall be liable for a security breach to the extent caused by the other party's failure to comply with its security obligations under these Terms.
21. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms (other than payment obligations) to the extent such failure or delay results from circumstances beyond that party's reasonable control, including but not limited to natural disasters, acts of government, pandemic, epidemic, war, terrorism, riots, labour disputes, internet or telecommunications failures, power outages, or third-party platform outages (including Meta/WhatsApp platform disruptions).
The affected party shall promptly notify the other party of the force majeure event and use commercially reasonable efforts to mitigate its impact. If a force majeure event continues for more than sixty (60) days, either party may terminate these Terms upon written notice.
22. General Provisions
- a. Entire Agreement. These Terms of Service, together with the Privacy Policy and any other policies or agreements expressly referenced herein, constitute the entire agreement between you and EventIQ with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, and understandings.
- b. Severability. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
- c. Waiver. No failure or delay by either party in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any right or remedy on one occasion shall not be deemed a waiver of that right or remedy on any subsequent occasion.
- d. Assignment. You may not assign, transfer, or delegate your rights or obligations under these Terms without EventIQ's prior written consent. EventIQ may assign its rights and obligations under these Terms without your consent in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of its assets, provided that the assignee assumes all obligations under these Terms.
- e. Notices. All notices required or permitted under these Terms shall be in writing and shall be deemed given when: (i) delivered personally; (ii) sent by email to the address associated with your account (for notices to you) or to company@event-iq.in (for notices to EventIQ); or (iii) sent by registered post to the addresses set out in Section 3.
- f. Relationship of the Parties. Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and EventIQ.
- g. No Third-Party Beneficiaries. These Terms are for the benefit of the parties hereto and do not create any rights in favour of any third party, except as expressly stated.
- h. Language. These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
23. Updates to Terms
We may revise these Terms of Service from time to time to reflect changes in our Services, practices, or legal requirements.
When we make material changes to these Terms:
- We will update the "Last Updated" date at the top of this page.
- We will notify registered Customers by email or through an in-platform notification at least fifteen (15) days before the changes take effect, where practicable.
- We will make the prior version of these Terms available upon request.
Your continued use of the Platform and Services after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Services and may terminate your account in accordance with Section 18(c).
